Florida Gov. Rick Scott has ordered a special election to fill a contested state House seat.

The move comes as the seat for District 64, which includes parts of northwestern Hillsborough County, Safety Harbor and Oldsmar, remains unsettled.

Although James Grant had the most votes in the general election, there is a lawsuit pending against the race and because of that, House leaders said they were uncomfortable acceptIng the election results.

The House voted during its organizational session to not accept incumbent Grant's victory.

There was confusion around the seat after a judge delayed the primary between Grant and Miriam Steinberg until November. Judge Angela Dempsey ruled that a write-in candidate in the race was ineligible because he didn't live in the district.

But an appeals court last month ruled that the write-in candidate should have remained eligible.

The ongoing confusion led Scott to issue an executive order this week, declaring there would be a special primary election Feb. 10. There also will be a new filing period for candidates interested in running.

Early voting in this election will take place Jan. 31 through Feb. 7.

A District 64 special election is scheduled for April 21. Early voting will be April 11-18.
