The Lake Alfred woman accused of killing her husband and burying his body in her herb garden has been found guilty.

A jury returned the verdict against Barbara Scott after deliberator for an hour and a half. She was found guilty of first-degree murder and tampering with evidence and was sentenced to life in prison.

Scott remained stoic as deputies led her out of the courtroom and back to prison, where she will spend the rest of her life.

Prosecutors argue Scott, 66, shot and killed her husband, Benny, in his own shower in 2012. They argue Scott wanted her sick, ailing husband dead so she could stop taking care of him, and so she stole a friend's gun and used it to kill him.

Scott has admitted to burying him in her herb garden, as well as lying to friends and family about her husband's whereabouts, but her lawyers tell a different story about his death.

"When Barbara Scott found him dead in the bathroom she didn’t know how to tell anybody," defense attorney Julia Williamson said. "She cried and she held him and she didn’t want to give him up."

Scott gave excuses to friends and family for months until she finally admitted to her daughter that his body was buried in the backyard.

"She made up stories after she buried his body," Williamson said. "That doesn’t prove murder on any level. First second manslaughter, whatever, doesn’t prove murder."

Physical evidence only shows Benny Scott was shot from a distance of less than two feet from the back of the head and that the bullet entered the top left side of his head, the coroner said. Benny Scott was right-handed.

The medical examiner has concluded his death was homicide, but another expert told the jury the body was too decomposed to be able to know for sure what happened.

Barbara Scott did not take the stand in this case. Her family did not want to comment on camera after the trial, but they were surprised by the verdict, as was her attorney.
