A woman will spend a year in jail and eight years on probation for having sex with her partner and not disclosing her HIV-positive status.

Kenyatta Massey had little reaction when the judge issued his sentence Monday in Orange County.

Before the ruling, her partner read an impact statement. He was visibly upset about if he had contracted the virus and was dismayed by her sentence.

Massey, 40, was arrested in December 2013 and charged with having sex on multiple occasions without telling her partner she was HIV positive, which is a first-degree felony in Florida.

According to her arrest affidavit, Massey admitted she had known she was HIV positive since 2006.

However, her partner didn’t find out until 2012, years after they had first been intimate.

"This is a first-degree felony punishable by up to 30 years in prison,” Judge Michael Murphy said. “Your attorneys handed me a waiver of rights form indicating you wish to resolve the case by pleading guilty or no contest."

Massey has 30 days to appeal the sentence.
