On the November ballot, it’s known as Amendment 2.

“If it’s passed and the city has no ordinance then we are required to do whatever the state wants us to do,” said Maitland Mayor Howard Schieferdecker.

Maitland is one of more than a dozen cities in Central Florida that are considering or have passed zoning ordinances regulating medical marijuana before voters even have the chance to decide on the issue.

Maitland city leaders told community members at a public hearing on Thursday night that they want to be proactive and regulate where medical marijuana dispensaries will be allowed in their city.

“I think they believe they’re trying to be prepared," said Republican political analyst Michelle Ertel. "But what they’re really doing is that instead of digging in and fighting this, which many of them don’t want this in their city, which is why they’re trying to regulate it, they’re just rolling over and accepting that it will be passed.”

Several cities in Brevard, Flagler, Lake, Orange and Volusia counties have already approved medical marijuana zoning ordinances.

“It sends a message to voters that this is going to happen, when we really don’t know that it’s going to happen," Ertel said. "Once it does pass or it doesn’t pass, they’ll have plenty of time after November to legislate this.”

“Absolutely. I’m 100 percent for [the zoning ordinance]," Schieferdecker said. "I don’t want the state telling us how to do it. The idea is we want to have our own destiny.”

Maitland Mayor Howard Schieferdecker said if Maitland is going to regulate medical marijuana, he believes they’ll need to approve their ordinance before election day on November 4.

According to a document provided to the City of Maitland by their legal counsel, attorney Virginia Cassidy, Cocoa Beach, Palm Shores, Edgewood, Lady Lake, Mount Dora, Flagler Beach and Ponce Inlet have all approved medical marijuana ordinances.

Tavares approved its zoning ordinance Wednesday. Deltona, Titusville, Winter Park and Cape Canaveral are also considering medical marijuana zoning and regulation ordinances in the near the future.
