TAMPA, Fla. — The Hillsborough County Sheriff's Office announced Tuesday that the State Attorney has finished its criminal review of the deputy-involved shooting in March that left a teenage paralyzed.

Criminal charges will not be brought against Deputy Daniel Estanislau.

The Sheriff's Office says the case was presented to a grand jury convened by the State Attorney’s Office.

Deputies released a statement that said, in part:

"We respect the decision of the grand jury and the conclusion of the Office of the State Attorney that no criminal charges are warranted in this matter. With the criminal review concluded and no prosecution justified, the Hillsborough County Sheriff's Office will now begin the process of conducting an internal administrative investigation which will review the facts and events of that evening and any applicable policies and procedures."

Estanislau allegedly shot the teen after responding to a domestic call on March 26 at the Jasmine Terrace Apartments in Tampa. The teen was suspected of hitting his sister and pushing his mother to the ground.

According to investigators, Estanislau came into contact with the teen and feared for his life, because he thought the teen had a gun.

The deputy yelled to the teen to get on the ground and drop the gun, then fired two rounds. The teen was hit once.

Attorneys representing the family released this statement today on behalf of the family of the teen:

"The State Attorney memorandum does not absolve the Deputy of wrongdoing. It only concludes that the State could not prove a crime beyond a reasonable doubt. We are confident that a competent and fair investigation by the Sheriff’s Office will conclude that the shooting was unjustified. As the State Attorney memo concludes, the Deputy shot at a teen who had complied with the Deputy’s command to show his hands. When the teen raised his hands to his chest and showed his hands, the only thing in his hand was a cell phone. Yet, the Deputy responded to the teen’s obedience by shooting at him, striking him in the back, and paralyzing him from the chest down. His entire life will never be the same because of the unjustified use of deadly force."

The teen's identity remains unknown because his identity was not released by the Sherriff's Office following the shooting. The family has not spoken publicly.
