LONG BOAT KEY, Fla.— The family of one of the victims in a double homicide in Long Boat Key is filing a lawsuit against the security company where the alleged killer worked.

Timothy Hurley and Kevin Carter were killed while working at the Zota Resort on Long Boat Key in August of 2017. The accused killer is Darryl Hanna Jr., who worked as a security guard at the resort.

Hanna was let go from the security company and hotel, but the Hurley family's attorney, Matt Morgan, says that Hanna's criminal past should have been looked at before he was ever employed. 

"It's our opinion this was preventable and very foreseeable and for that reason they have filed a formal complaint in this matter. They are seeking damages for the loss of a love one," said Morgan. 

Eric Arapi, manager of United American Security in Tampa, says every prospective employee is thoroughly screened.

"We will do a social security and address trace. As well as a national criminal and sex offender trace. We'll also conduct a county criminal history, and modern vehicle driving record check," said Arapi.

Attorneys say that this may have not been the case with the agency that hired Hanna, called Victor Security Agency.

Attorneys also say that Hanna had a previous arrest for theft and other charges that were all public knowledge before he was hired.

"It's our opinion this was preventable and very foreseeable and for that reason they have filed a formal complaint in this matter," said Morgan. "They are seeking damages for the loss of a love one."

It is unknown at this point how much the family is seeking.

The Carter family has confirmed that they will not be joining the Hurley family's suit.

We reached out to Victor Security Agency for a response and they did not comment. 

Hanna suffered a medical episode that left him in a vegetative state while awaiting trail. 

A judge recently ruled that Hanna will live out his life under the care of his mother.
