"I just thank God that no kids were hurt, nobody in that lunch room was hurt," said Nocco. "There was approximately 10 kids there. It's sad what we have to do today. It would've been tragic if a child was harmed."
Authorities initially said SRO Jonathan Cross was leaning against a wall in Thomas E. Weightman Middle School on April 30 when the gun fired. Nocco said Wednesday that an investigation found Cross was moving the gun up and down in its holster, and that's what caused the weapon to fire.
"Our members are trained on our weapons on proper handling. The actions the former member displayed are nothing that we train. We train for the opposite, that every time you use that weapon, you have to remember it is a deadly weapon," said Nocco.
Nocco said Cross has been employed with the Sheriff's Office since 2005 and has been stationed at Weightman for two years. According to the sheriff, Cross admitted to having a habit of "fidgeting" with his gun, and a student also told investigators he had seen Cross "fool" with the gun in the past.
The type of gun Cross was carrying, a Sig Sauer 9 MM P320, has had some issues. Last year, there were reports that some P320s fired when dropped or jostled. Nocco said the Florida Dept. of Law Enforcement conducted an independent test of the weapon and found nothing wrong with Cross's gun.
Nocco said his office presented the case to the State Attorney's Office, which chose not to criminally charge Cross.
