DeSantis suspended Warren in August over the prosecutor’s signing of statements that said he would not pursue criminal charges against seekers or providers of abortion or gender transition treatments, as well as his policies about not charging people with certain minor crimes.
Warren sued to be reinstated.
In the ruling, Federal Judge Robert Hinkle said he lacks the proper authority to reinstate Warren as state attorney but determined that DeSantis was wrong to suspend him.
Friday afternoon, Warren thanked those who have supported him over the last few months.
"The trial is a search for the truth and over the last five months the truth has come out," Warren said, accusing DeSantis of an "abuse of power."
"The suspension was always a political stunt, a cheap trick," he said. "A federal judge has confirmed that the suspension was illegal."
"This is not over."
According to court records, the judge determined DeSantis was in the wrong — that the governor violated both the Florida Constitution and the First Amendment by suspending Warren.
DeSantis accused Warren of resisting the state's new 15-week abortion ban.
”The allegation was false. Mr. Warren’s well-established policy, followed in every case by every prosecutor in the office, was to exercise prosecutorial discretion at every stage of every case,” Hinkle said.
A statement from Clerk of Court Jessica J. Lyublanovits said: "The plaintiff Andrew H Warren's claims against the defendant Ron DeSantis arising under state law are dismissed without prejudice based on the Eleventh Amendment. Mr. Warren's claims against Mr. DeSantis arising under federal law are dismissed on the merits with prejudice."
Warren can either file the case in state court, take his case before the Senate, do nothing at all, or decide to run for office again.
